Kentucky Highway Closed Following Fatal Car Crash

An early morning car accident closed down an Eastern Kentucky highway for over two hours.

At about 7 a.m. this morning, two vehicles crashed on US 23 next to the Highway 80 Intersection, according to officials with the Prestonsburg Police Department.

A 19-year-old man of Flat Gap was traveling north on US 23 when he crossed the center line and struck another vehicle driven by a 19-year-old man, of Salyersville.

A third vehicle was struck by flying debris from the accident, said Prestonsburg Police Chief. Three people were transported to Highlands Regional Medical Center.

One driver was killed while the third driver was not injured in the accident.

The accident is under investigation. Police believe heavy fog may have been a contributing factor to the accident. They ask anyone with information that may have witnessed the crash to please contact them.

Originally posted at InjuryBoard by Chrissie Cole

Semi Tractor Trailer Truck Drivers Urged to Stay Away From Chantix

Operators of Semi Tractor Trailer Trucks as well as those that fly Planes and Air Traffic Controllers have been banned from using the prescription drug Chantix.

The Federal Aviation Administration joined the Federal Motor Carrier Safety Administration in banning the use of the prescription drug that helps break the habit of smoking.

The nonprofit group concludes, “We have immediate safety concerns about the use of varenicline (Chantix) among persons operating aircraft, trains, buses and other vehicles, or in other settings where a lapse in alertness or motor control could lead to massive, serious injury. Other examples include persons operating nuclear power reactors, high-rise construction cranes or life-sustaining medical devices. Based on reports of sudden loss of consciousness, seizures, muscle spasms, vision disturbances, hallucinations, paranoia and psychosis, we believe varenicline may not be safe to use in these settings.”

Injuryboard and Daryl T. Dixon Law stands ready to assist any of those with claims against Drug Companies and those who are injured by Semi Tractor Trailer Trucks.

Pendleton County Kentucky Bus Crash Sparks Fears in Western Kentucky

The Pendleton County Kentucky Bus Crash from Thursday sparked fears with Western Kentucky School Officials. The facts of that case hit way to close to home for many in Western Kentucky.

A dump truck crossing the center line on a windy country road. With the many rural areas in Western Kentucky we have been blessed not to have a Kentucky Bus Crash here in our back yards. The many small counties and the windy roads, passing gravel and stone trucks, makes us very fortunate.

My friend and fellow Injury Board Attorney Sandy Grinnell from Florida wrote an article on School Bus Safety. Read it and then post comments on this topic. I will do a feature in the near future on more Kentucky School Bus Safety Tips for Parents of Kids Riding and some suggestions for the industries that make these buses.
Originally posted at InjuryBoard by Daryl T.
Whitco Co. Stadium Light Poles Recalled

A nationwide alert was recently issued by the CPSC warning facility managers and school officials to inspect outdoor stadium light poles manufactured by Whitco co. because the poles can crack or fall over, posing a risk of serious injury to bystanders.

Nine incidents of the poles falling, including one that went through the roof of a school gym has been reported to the agency so far. While most of the incidents have occurred in Texas, the poles have been installed in other states as well.

All Whitco LP stadium poles should be inspected immediately by a qualified professional to reduce the risk of additional falling poles. If there is any signs of deterioration, cracks or factures, the affected poles should be repaired/replaced immediately.

For more information regarding this warning, consumers can e-mail the agency or contact CPSC’s Hotline anytime at (800) 638-2772. #

Kentucky Hit and Run Accident Investigation

Police are searching for a car that hit and killed 37 year old Mark Little. He was found on Highway 172 in Johnson County. There were some reports of seeing Little walking down the road, but no one knew why. Investigators say that Little was wearing dark clothes, but they didn't know how he got hit or why the driver fled the scene.

Little's family has suffered a temendous loss. Mark's father died just last week, now this second death in the family has left them traumatized. Authorities are asking residents to keep thier eyes open for any recently damaged vehicles and to call a local police station with any report.

Certain measures should be followed after any accident. Kentucky requires any driver involved to pull over and exchange identification and contact information. Failure to submit to this law, at minimum, gets you a traffic ticket. If you leave the scene of a serious accident however, you can be charged with a 'felony hit and run'.
Originally posted at InjuryBoard by Daryl T.
A Semi Tractor Trailer Accident Takes the Life of a Tennessee Man on the Western Kentucky Parkway

A 70 year old Tennessee Man was killed on the Western Kentucky Parkway last Monday after being struck by a Semi Tractor Trailer Truck.

Joseph E. Litz of Clarksville, had stopped to tighten his gas cap when the Semi Truck hit his car and trailer before hitting another car. The accident happened near Mile Marker 114 of the Western Kentucky Parkway.

Litz and his wife were traveling to Louisville to attend the Kentucky State Fair.

This story sparks more discussion of the need for new laws concerning vehicles that are pulled off of the side of highways and Interstates. I recently wrote an article on a newly signed law in the state of Illionois called "Shibs Law" that allows Emergency Responder to close Highways and Interstates when duty calls.

In this case Mr. Litz was not an Emergency Responder but still should have been afforded some protection while stopped on the side of the road. A Potential New Law for Kentucky could require all Motorist to pull into the left hand lane when they see another motorist stopped on the side of the road. It is a Law that motorist must pull into the left lane when they see a Police Officer pulled off the road.

The need for this type of legislation is underscored when we see preventable accidents, such as this case. It appears that this accident was caused by a Professional Driver who was inattentive to a motorist pulled to the side of the road.

I would be interested in any comments on this issue and the need for some sort of law protecting motorist pulled to the sides of the roads.
Originally posted at InjuryBoard by Daryl T.
"Shib's Law" needed for Kentucky Emergency Responders

Last July, a 43 year old firefighter was hit by a Greyhound Bus after he was called to the scene of a Tractor-Trailer Fire on Interstate 57. He was rolling hoses when he was killed by the driver who didn't slow down for the Roadside Emergency, clearly lit by emergency lights and traffic cones.

Family of the fallen man, James "Shib" Miller, pushed their petition until it was passed by Governor Blagejovich. The bill is now called "Shib's Law" and it allows firefighters and other emergency responders to shut down traffic on Highways and Interstates until their work is complete.

The tremendous loss left a hole in Miller's family, but they feel that his death was not a complete loss. Their other son and many friends are also firefighters, and this law makes them feel that their comrades are a lot safer now. Their only hopes now are that no other families have to deal with the heartache that they have.

So... is it Kentucky's turn to pass "Shib's Law"?
Originally posted at InjuryBoard by Daryl T.
